general has broken his silence for the first time since election day, ordered the us attorney to investigate any allegations of voter irregularities that he deems to be, quote, substantial. as you know, we got from election day some states tallying up the votes because of historic voter turnout. let's look at the attorney general said in his statement. investigations should occur if there are clear and credible allegations of irregularities that could potentially impact the outcome of the federal election in individual state. the department of justice official who oversees these investigations stepped down on monday following the release of this authorization from the attorney general, the white house claiming democrats are welcoming fraud without providing tangible evidence,

really does all come down to the senate races in georgia, the balance of power hangs in the balance so what happens if democrats win and control the house, senate and executive branch? >> i don't think there's any question the divided government where you have different parties in control of different parts of the legislature is a better government, makes all of us have to work together. balance of power is important. it is obvious we made gains in the house we are not going to make it to where we have the majority. it is going to be very close. i suspect we will end up with 210-212 which will make democrats in the house have to work with us but they will still be in the majority in the house which having the majority in the senate is going to be crucial and that will decide the balance of power and make us all have to work together. >> senators purdue and leffler called on the gop secretary of

state to resign saying what they say are failures in georgia's elections. this is what he had to say, quote, as a republican i am concerned about republicans keeping the u.s. senate. i recommend senators (purdue start focusing on that. does he have a point? these senate seats are crucial for republicans and being able to hold onto the senate. does their focus need to be on that and what do they need to do leading up to january 5th. >> their focus is on their race, no question about it. both of them are going to win, georgia is going to send two republican senators to the united states senate. i'm confident of that. they will do what they have to do to win. the secretary of state has a lot of concerns, we have a lot of concerns for the secretary of state even with the house delegation. i suspect the republican party as well as the trump for president campaign will make some requests to the secretary of state of how to make sure

that we have an election where every illegal vote is counted. we had serious problems in the state of georgia. regardless what party the secretary of state maybe and we need to make sure that office is doing their job. >> chuck schumer, mitch mcconnell were sparring over the coronavirus stimulus deal again. this is been going on for months. what are we going to get a deal? >> that's up to the democrats, up to nancy pelosi, nancy pelosi stood in the way of this. i will tell you i am not one who subscribes to the ideas that we need to add more money to our national debt. i get it. i understand there are needs, people are still hurting. however we still have $1 trillion left from the first four packages we put together and appropriated it hasn't been spent yet. why don't we redirect or repurpose the money instead of adding more money to the national debt?

thank you for being here. i feel we haven't talked about this in a few days, a lot of news happening, get us updated. what do you expect to see happening? >> andrew mccabe was deputy director of the fbi under jim comey. they opened an investigation on presidential aides to -- presidential candidate aides to donald trump. they authorized -- andrew mccabe authorize the most intrusive technique you can use against an american citizen which is fisa. you can read emails, texts, intercept phone calls, even go into somebody's house without a warrant and rummage through their records of the court authorizes that. we find out later through the inspector general this was flawed information, inaccurate information, discredited information and the people who approved it up preferred further up the chain, sally it, rosenstein and jim comey says

sit here in november, that is a phenomenal rate of speed and appears to be a very effective vaccine and their four other candidate vaccines in the pipeline in quick order. this is tremendous news for this country and worldwide. and the administration which committed to buying the doses before the fda approved them, you have to have cold storage you normally wouldn't have in a place that will stockpile the virus and that work has been done. this administration has leaned into this problem unlike previous administrations where i worked and that included an administration that included joe biden. we did not see this when the vaccine was finally produced. it was two months later before it was available for anyone. that would not be acceptable in

jillian: welcome back ag barr instructing the doj to investigate voter fraud claims. carley: joining us brett tollman, good morning, sir. the attorney general is stepping up and stepping in. he released a statement saying this he says investigations may be conducted if there are clear and apparent allegations of irregularities if true could potentially impact the outcome of a federal election. how significant is this? >> it's significant but let's pretend there hasn't been voter fraud before and the doj hasn't looked into it. this is normal, regular process for the department of justice to be looking into allegations. and if they are serious, they

will pursue them. if they're credible, they will pursue them. if not, then they won't. jillian: i want to get your reaction to the biden campaign statement to this and this reads quote it's deeply unfortunate that attorney general barr chose to issue a memorandum that will only fuel the speculative fanciful or farfetched claims he professes to guard against. what do you think about that statement. >> it's absurd. it would be absurd because of whin mattershot attorney genera. they have been doing it for hundreds of years. the reality is, this attorney general or any attorney general is not going to appear in court and presence evidence of issues they find to be credible unless they have the facts to back them up. nothing more embarrassing or difficult than being in front of a judge and not having the evidence that you claim you have. jillian: you know president

trump's re-election campaign yesterday they filed another lawsuit in pennsylvania allege ago two-tiered voting system that could be unfair. can you explain that and how much does this hold weight? >> >> well, look, we are hearing allegations that are now being put into sworn affidavits and what that means is somebody that is on the ground observing is willing to go under oath and to swear to certain facts. and the facts that they attest to in pennsylvania and nevada. and i understand they may be coming forth in wisconsin. are facts that suggest that there were different standards being applied. that those that were voting, if they -- there was something wrong with the vote that was being cast, that there were individuals that were instructed to ignore defaults in the vote. if that's an actual fact and

they can show it, then they also have to show is it widespread? and we have heard numbers like 25,000 votes, for example, that may have been harvest you had from elderly in nursing care homes. so, we don't know at this point and we have some time. let's sit back and let the process go forward. and, if it's real, it will gain traction. jillian: bret, we have about 30 seconds left and i want to get your opinion on this. the affordable care act is heading to the supreme court again the individual mandate. this is a highly conservative court. what do you see happening? >> well, i learned long ago to rule one way may rule different way. it's true there is a majority here. they are going to look at was the district court right when it said that the individual mandate was unconstitutional? and is it so significant that it's going to render the whole
